By accessing and using Plus100.club (“the Website”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Plus100.club provides educational tools and calculators for freediving planning and training. Our services include dive profile calculators, buoyancy planners, pool training planners, and related educational content.

3. Important Disclaimer

We strongly recommend completing a certified freediving course before attempting any freediving activities. The information provided through our tools should be used as a supplement to, not a replacement for, professional training and guidance.

4. User Responsibilities

As a user of our services, you agree to:

• Use our tools responsibly and within your skill level
• Not rely solely on our tools for dive planning
• Always prioritize safety over performance
• Seek professional training before attempting advanced techniques
• Not use our tools while under the influence of drugs or alcohol
• Report any errors or issues you encounter

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLUS100.CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or death resulting from freediving activities
• Property damage or equipment failure
• Financial losses or medical expenses
• Emotional distress or mental anguish
• Loss of data or information

Our total liability to you for any claims arising from the use of our services shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

6. Intellectual Property Rights

All original intellectual property of the service, including but not limited to the Website, its original content, features, functionality, design, and code, are and will remain the exclusive property of Plus100.club and its licensors. The Website is protected by copyright, trademark, and other laws.

User-Created Content: All content created by users, including but not limited to dive plans, training data, comments, feedback, and other user-generated content, belongs to the respective users who created it. Users retain ownership of their original content.

License to Use User Content: By creating content on our platform, users grant Plus100.club a non-exclusive, worldwide, royalty-free license to use, promote, process, and display their content in connection with the operation and improvement of our services. This license includes the right to:

• Display user content on our platform
• Use user content for service improvement and development
• Process and analyze user content for service optimization

Content Privacy: Content that is not explicitly marked as public or shareable will not be used to promote the website in marketing materials or internally without your explicit consent. We respect the privacy of your personal training data and dive plans.

User Rights: Content creators have the right to request the removal of their content from our platform at any time. We will process such requests within a reasonable timeframe, subject to our legal obligations and the need to maintain service integrity.

Content Sharing: Users are only allowed to share content from the platform if it is explicitly marked as shareable on the platform. Any content that is not marked as shareable may not be distributed, reproduced, or shared outside of the platform without our express written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website.

7. User Accounts

If you create an account on our Website, you are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to:

• Provide accurate and complete information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

7.1. Free Account Tier

Plus100.club offers a free account tier that is available forever at no cost. The free account tier includes at least the following features:

• Complete workout planner access
• Unlimited workout tracking
• Template library and customization
• Progress analytics and insights
• Mobile and desktop access

This list represents the minimum features available in the free tier. Additional features may be added to the free tier at any time and are not limited to those listed above.

8. Training Centers

Plus100.club offers training center capabilities for structured coaching and athlete management. Training center owners can establish their organization on the platform, participate as instructors, and invite additional instructors to collaborate in supporting athletes. Users may join multiple training centers as athletes or as instructors.

8.1. Joining as an Instructor

Instructors may be added to a training center and, for coaching purposes, may view and manage athlete data within their assigned training center. Instructor capabilities include:

• Viewing athlete workout plans and progress
• Creating and assigning workout templates to athletes
• Providing feedback and coaching notes
• Accessing training analytics for assigned athletes

Instructors must maintain professional confidentiality and respect athlete privacy. Access to athlete data is limited to what is necessary for coaching and remains subject to the athlete-selected access date and applicable privacy settings.

8.2. Joining as an Athlete

Athletes may join training centers to receive coaching and guidance. Upon joining, athletes select the earliest date from which the training center may view their training history. This access date defaults to the date of joining and cannot be modified thereafter. To change it, the athlete must leave the training center and rejoin with a new access date.

• Instructors may view training data starting from the athlete-selected access date
• Athletes may leave a training center at any time
• Instructors may add workouts to an athlete's calendar
• Workouts added by instructors are visibly marked with the training center logo

9. Prohibited Uses

You may not use our Website:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website
• To attempt to gain unauthorized access to any portion of the Website or any systems or networks

10. Termination

We may terminate or suspend your account and bar access to the Website immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Poland, without regard to its conflict of law provisions. Our service is operated from Poland. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. Your continued use of our services after such changes constitutes acceptance of the updated terms.
